Covered Business Method Proceedings

Covered Business Methods (CBMs) are trial-like proceedings that allow a named defendant in a patent infringement lawsuit relating to a business method to challenge the enforceability the patent claims before the PTAB.  A CBM petition can be brought at any time by a named defendant if the patent in question does not describe a “technological invention.”  Once a CBM proceeding is instituted, it generally follows similar procedures as with IPR and PGR.
